Recent Success Stories
DJS termination reversed. MCEA successfully appealed the
termination of a Resident Advisor II from the Eastern Shore Children's
Center. The Office of Administrative Hearings ordered Shanell Taylor
back to work with full back pay and benefits after our union proved
she should not have been blamed for inappropriate activities that
took place between the juvenile delinquents who were left in the
care of two other employees while she was out of the room. (May

MCEA wins holiday case. MCEA won compensation for bargaining
unit employees in the UMCES non-exempt unit and the Bowie State
University Police unit. MCEA had negotiated contracts that the university
employees at these schools would receive any holiday designated
by the U.S. President or Maryland Governor. This year, President
Bush declared Jan. 2 a day of mourning in recognition of the passing
of former President Gerald Ford. The Office of Administrative Hearings
agreed that employees should be compensated for Jan. 2. (June 2007)
If you are asked to sign a waiver of your rights ("resign
or face termination" or of the "30-day rule"), call
your Labor Relations Specialist IMMEDIATELY for advice FIRST. If
you are not allowed the opportunity to meet or consult with your
union representative or an attorney, decline to sign until you do

MCEA wins CO's job back - again. Back in 1997, the Department
of Public Safety and Correctional Services terminated a Correctional
Lieutenant from the Eastern Correctional Institution for allegedly
losing a set of keys. MCEA won his reinstatement with full back
pay and benefits. On the day the Lieutenant was returned to work
in 2002, the agency terminated him again - this time for alleged
misconduct he engaged in after he had been fired. On appeal to the
Court of Special Appeals, MCEA had the second termination overturned.
Management never met with the employee before dismissing him - a
violation of personnel law.

1. I believe I have been unfairly disciplined.
What should I do?
To receive professional, effective grievance representation, MCEA
members should contact our headquarters office at 410-298-8800 or
1-888-611-MCEA, ext. 227 for assistance. Our union will file an
appeal within the specified time limits required by your respective
personnel system. For example, if you are under the State Personnel
Management System, you must file your grievance within 20 calendar
days of the cause of complaint and within 15 calendar days of notice
of disciplinary action. (Click here
for a SPMS grievance form). A University System of Maryland
employee must file a grievance
within 30 calendar days and appeal disciplinary action within
five calendar days. The time limits for Department of Transportation
employees are 30 calendar days for a grievance and five calendar
days for disciplinary action.

MCEA provides members an attorney to represent them before the
Office of Administrative Hearings (or other administrative level
for county employees) at no charge other than our union dues.
MCEA also provides advice and consultation on workplace concerns.

System of Maryland. How can I learn more about personnel regulations?
USM
personnel regulations are online. For further explanation,
employees may call their campus human resource offices. MCEA members
also may contact their Labor Relations Representatives for clarification.

To review your classification grade, salary range, service category,
and eligibility for cash overtime, refer to the Department of Budget
and Management web site for the salary
plan or contact your agency's personnel office.

5. What rights do I have as a contractual/contingent
employee?
Contractual employees may not appeal disciplinary action under
the grievance procedure. However, they are eligible for MCEA membership
and our dental plan, legal plan, and other benefits. Our Labor
Reps will provide dues-paying members advice and consultation
for job-related problems and may appeal a termination or rejection
on probation if it was imposed for illegal or unconstitutional
reasons. Certain personnel systems and universities provide limited
benefits to contractuals. Check with your personnel office.

standard salary or USM salary structure?
The State's biweekly pay plan (http://compnet.comp.state.md.us)
can be found on the Comptroller of the Treasury's web site. On the
USM web site are the USM nonexempt salary structure (http://www.usmd.edu)
and the exempt salary structure (www.usmd.edu).
Other state salary schedules are listed on the Department of Budget
and Managment's Web site at www.dbm.state.md.us.

State workers may donate unused annual, personal and sick leave
to the bank, in accordance with established procedure. Leave
bank guidelines include information about the application process,

to complete, membership, medical documentation, and other details.
